The Benton County jail in Arkansas has a new policy that mandates prisoners pay for their own emergency medical treatment on ailments existing before their incarceration. Benton County Sheriff Keith Ferguson said he doesn't think it's fair to ask taxpayers to pay for pre-existing illness that inmates suffer before they end up in his jail. The American Civil Liberties Union's chapter in Little Rock argues that Ferguson's new rule may violate an inmate's constitutional right to adequate medical care. ACLU attorney Grif Stockley said it could become dangerous if local hospitals won't treat inmates with outstanding medical bills. Jeff Walker, a criminal justice professor at the University of Arkansas at Little Rock, said Ferguson's policy could begin a trend nationwide. Walker said there is no state or federal law requiring counties to pay for inmate medical treatment. |
