The Pennsylvania State Correction Institution at Camp Hill can forcibly treat an inmate who remains on a hunger strike, Cumberland County Judge Edward Guido has ruled. In a lawsuit filed in October, prison lawyers say Abdel Fattah, 35, has been fed “via a Nasogastric Tube” since January. Earlier that month, he showed symptoms of illness, but refused to allow prison doctors to treat him. Guido's ruling permits the state prison to “administer mood stabilizers, antipsychotic and antiparkisonian medication to the defendant as it deems necessary and using whatever mode it deems necessary.” In addition, Guido gave the prison permission to “use its best efforts to find a surgeon to insert a jejunostomy tube to save this man's life.” However, if Fattah removes the tube, the prison “is under no obligation to have it re-inserted without further order by” the court, the judge wrote. ]Guido is familiar with the Fattah case. He issued a court order in April 2003 that permitted the prison to “involuntary examine and perform invasive diagnostic tests on (Fattah) and ... administer medical treatment, including nutrition and hydration.” On Oct. 11 and 12 this year, the prison medical staff witnessed Fattah coughing up blood clots after his evening feedings. Normally housed in the “Special Management Unit,” Fattah was transferred to a special observation cell in the infirmary. After he vomited blood, the medical staff ceased feeding Fattah with the tube “because medical staff is concerned that Mr. Fattah might have suffered some form of internal damage that might be exacerbated from continued ... feedings,” the lawsuit says. In its lawsuit, SCI-Camp Hill officials said allowing Fattah to die would “demoralize” the prison and provoke animosity towards staff. Fattah has staged at least three hunger strikes, the lawsuit reads. Previous hunger strikes took place while Fattah was housed at state prisons in Greene and Waymart in 2002-03. |
