Kentucky Court Denies Appeal

The Kentucky Supreme Court has denied the appeal of a death row inmate convicted of killing an eastern Kentucky couple.

The court's ruling was released Thursday morning following an appeal from the attorney for Roger Epperson. Last fall, Randy Wheeler told the high court that Epperson should be granted a new trial because of flawed instructions from a judge to the jury, along with the prosecution failing to produce witnesses.
In their ruling, however, the court said it was unconvinced that the appeal was worthy of a new trial.

Epperson is on death row after being convicted of killing Edwin and Bessie morris in 1985, during a robbery in Jackson County. Epperson has already been granted a new trial in this case once before. His original conviction was overturned because of errors.

There is no word on whether an execution date will now be set for Epperson.
