| Young refugee loses U.S. suit for prison beating |

Malik Jarno, a young refugee from Guinea who is mentally retarded, last Thursday lost a civil suit claiming damages for a beating he sustained in a Virginia jail. A jury in U.S. District Court in Alexandria found in favor of a jail sergeant and three officers who had been accused of pepper spraying and brutally beating Jarno in Piedmont Regional Jail in November 2001. Jarno, now 18, arrived in the United States with a forged passport in January 2001. He has been held in a variety of jails ever since while immigration authorities try to deport him. His lawyers have argued he would face danger and possible death if returned to his native land. His case has become a symbol for the plight of some 5,000 unaccompanied minors held in detention by U.S. authorities each year while their claims for asylum are adjudicated. Three senators and 13 members of the House of Representatives have appealed for Jarno to be given asylum. The civil suit arose from events at Piedmont Jail in central Virginia, when Jarno became involved in a disturbance caused by another inmate. Two witnesses testified he was pepper sprayed without provocation and later severely beaten by officers in a hallway. But the jury sided with the officers who argued they were following approved procedures to maintain jail discipline and protect themselves. The jury was never told that Jarno is mentally retarded. Different psychologists measured Jarno's IQ on three separate occasions and found he was functioning at the mental level of a 10-year-old. His lawyers were also unable to conclusively prove that he suffered lasting injury from the incident although a jail nurse admitted on the witness stand that his treatment record had been tampered with and his signature forged. |
