North Dakota's state prison system gives female inmates fewer opportunities for treatment, education and work, two prisoners contend in a newly filed federal lawsuit. They believe the recent opening of a new women's prison will make things worse. The lawsuit, filed in U.S. District Court in Fargo, uses a recent study of North Dakota's prison system to argue that female inmates are provided "unequal and inferior" housing and programs. Women inmates are being transferred to a recently opened prison in New England, a community in rural southwestern North Dakota, and a county jail in Dickinson, before the two facilities "are equipped to provide them with equal facilities, services and programming," the lawsuit says. Elaine Little, the director of the state Department of Corrections and Rehabilitation, said she was confident the state could defend the move. Among the female inmates' complaints is that male prisoners have more options for prison work and housing. At the main state penitentiary in Bismarck, male inmates who are well behaved may be eligible to live in an "honor dorm," while no comparable incentive is available to women, the lawsuit says. Little said some of the lawsuit's assertions are inaccurate. It contends, for example, that women inmates at the James River Correctional Center in Jamestown may not use an addiction treatment program at the local county jail. Women were not barred from the program, Little said, and in any case, it has been moved to facilities at the state psychiatric hospital. The James River prison is on the state hospital's campus. Julie Roubideaux and Shelly Grossman, both inmates at the James River prison, filed the lawsuit on behalf of all female inmates in the system, going back six years. Both women are serving time for drug crimes and other offenses. Their lawsuit demands unspecified compensatory damages, and a court order requiring North Dakota's prison system to provide equal treatment for male and female inmates. |
