| California Police Officers Win Suit Over Ex-Inmate |

A former death-row inmate lost his civil rights lawsuit last week against two Long Beach police detectives who helped send him to prison for robbery and murder in 1983. U.S. District Court jurors brought an abrupt end to the three-week trial by returning a verdict after only three hours of deliberations. Oscar Lee Morris brought the federal suit after being released from prison based on the alleged death-bed recantation of an informant. The informant was used to convict Morris of a 1978 murder of a man in a Long Beach bathroom. In his lawsuit, Morris claimed the informant's testimony should never have been used in the first place because he was offered 'favors' in exchange for the testimony. The informant was in prison for grand theft auto at the time, and the prosecutor in the case wrote a letter to the informant's parole board recommending leniency. Morris' attorney was never told about the letter. As a result, the California Supreme Court in 1988 reversed Morris' robbery conviction, which won his release from death row. The court ruled that the informant's testimony was critical to the robbery conviction, but not the murder conviction. In California, murder during the commission of a robbery is a capital crime; murder by itself is not. Morris served another decade in the general prison population before being granted a retrial in 2000 when the informant recanted. Prosecutors refused to retry Morris, and he went free. Deputy City Attorney Bill Reidder, who tried the case for Shannon's office, called the recantation 'an under-the-cover recitation with nobody who can verify it one way or another.' Nonetheless, Morris was released from prison free to pursue a lawsuit. Police officials said they did not deprive Morris of his civil rights. Jurors apparently agreed. They returned their verdict in U.S. District Court Judge Florence-Marie Cooper's courtroom Wednesday afternoon. |
