| N.Y. Jailer Alleges He Was Punished for Public Comments |

A jails administrator sued the city for $5 million Tuesday, saying he was demoted in retaliation for public criticisms, including that correction department budget cuts were a threat to safety ''inside and outside of the jail.'' Dane Martin said in the lawsuit in U.S. District Court in Manhattan that he was punished by the Department of Correction after he was interviewed by a newspaper reporter in May in his role as president of the Association of Caribbean Americans in Corrections. At the time, he was in the midst of a probationary period after being promoted to assistant deputy warden on July 20, 2001. He said in the lawsuit that he had successfully completed three formal reviews before he spoke to a Newsday reporter for a June story that carried the headline, ''Jail Officers: Cuts Risk Safety.'' In the article, he was quoted as saying that a city plan to cut 511 jail positions ''will jeopardize the safety of staff, inmates and the community.'' ''This does affect safety ... both inside and outside of the jail,'' he said. Two days after his superiors learned of the comments, he was accused of improperly supervising an inmate count at a city jail, the lawsuit said. Nearly two months later, he was told that he was demoted, the lawsuit alleged. Department of Correction spokesman Tom Antenen said the lawsuit was without merit and the promotion was denied ''based on work performance.'' Antenen said the lawsuit incorrectly identified the jail facility in which Martin was accused of improperly supervising the inmate count. ''He left the facility prior to the count being cleared, and there was a problem. The warden, when informed of that, deemed that to be an egregious violation,'' Antenen said. ''If they can't even get the jail right, I don't think they have much hope.'' |
