A former Parker County Jail inmate has filed a civil rights lawsuit that alleges he was denied medical attention while incarcerated. He is seeking $1 million in damages.
The lawsuit was filed in the Fort Worth division of the U.S. District Court for the Northern District of Texas. It alleges that the former inmate, Michael Dewayne Warren, was refused medical attention while he was at the jail following a gallbladder surgery in 2001. Brown has filed a response to the lawsuit. The sheriff and a Corporal Rosenbach, whose first name is not given in the lawsuit, are named as defendants.
The original civil rights complaint said that Warren was in jail and was taken to have gallbladder surgery at Campbell Memorial Hospital in Weatherford on Nov. 26, 2001. It says Warren was released from the hospital Nov. 29, 2001, transported back to the jail, returned to the hospital because of complications resulting from the surgery and returned to the jail again. The complaint alleged that on Nov. 30, 2001, Warren was denied medical attention.
The response to the lawsuit says that Warren's claims in the suit are barred by the doctrine of qualified immunity, which says that government officials are immune from liability for civil damages if their conduct does not violate clearly established statutory or constitutional rights. The response acknowledges that the plaintiff was treated in the emergency room at Campbell Memorial Hospital four times. It also says that Warren was diagnosed with gallstones and was treated by a doctor and given pain medication.
