| Mom Sues Michigan Prison for Inmate Son's Death |

The mother of a 25-year-old inmate who died of a heart attack at the Oaks Correctional Facility has sued, claiming neglect of her son's medical condition by prison staff amounted to cruel and unusual punishment. The suit charges that corrections officers ignored pleas for help and obvious symptoms of a serious medical disorder for up to 13 hours before sending inmate Jonathon Cross to a hospital, where he suffered a heart attack and died. A spokesman for the attorney general, representing the state correctional facility, said his office had not been served with the suit so he could not comment. Plaintiff attorney William McHenry, who along with his law partner Geoffrey Fieger filed the suit on behalf of Cross' mother, Florence Short, said a doctor at West Shore Hospital characterized the prison staff as negligent. No criminal charges were filed. Manistee post commander Lt. Brian Postma confirmed that an investigation into Cross' death took place but he said such investigations are routine. Cross was serving consecutive sentences of five years and 16 months for convictions in Lenawee County for larceny from a motor vehicle and attempting to abscond from bond. He was almost six years into those sentences when he died in May 2000. He was scheduled to be released the following December. The suit contends that corrections officials knew of a pre-existing heart condition suffered by Cross and that the staff ignored pleas for help and symptoms such as difficulty breathing, vomiting, incontinence, abnormal pulse and blood pressure, and unresponsiveness. The suit, filed in U.S. District Court for the Western District of Michigan, charges that corrections staff showed reckless disregard to Cross' health, a violation of the Eighth Amendment, which prohibits cruel and unusual punishment. |
