| Ex-Inmate's Death Puts End to City's Legal Ordeal |

The recent burial of a former Shreveport City Jail inmate who was severely beaten while housed in the city lockup brings to a somber end an almost yearlong ordeal that cost Shreveport taxpayers nearly $4.9 million. Carl Janski, 60, died December 12, but was recently the subject of the largest legal settlement in the city's history. 'We've been through a lot, and the son was looking forward to doing a lot for his father and it's been dramatically cut short,' said Shreveport lawyer Craig Smith, who represented Janski's only son, Steve Janski of Fayetteville, Ark. Last May, Steve Janski filed suit in U.S. District Court seeking unspecified damages in the beating of his father. He claimed the city was grossly negligent for not properly staffing the jail, failing to have proper security measures in place and failing to provide medical care for his father. Janski had been arrested on charges of public intoxication and entering and remaining. While he was locked in a cell with three other inmates, Janski suffered severe head trauma after he was beaten by another inmate who, according to jail reports, became irate over Janski's body odor. Janski survived the beating, but was rendered incapable of caring for himself and was in a long-term assistant care facility in Arkansas when he died. Three weeks ago, the city settled out of court for $4.9 million. The legal arrangement - a reversionary trust fund - called for the city to pay Janski's future medical expenses. 'We put a certain amount of funds in an annuity so (Janski) could pay for future medical expenses,' City Attorney Ramon Lafitte said. 'Whatever (money) that is left in the (annuity) will be coming back to the city.' An estimated $1.5 million is expected to stay in the city's coffers from the settlement, Chief Administrative Officer Ken Antee said. Smith said Friday there will be no additional legal action. 'I believe the settlement was fair and that's why it was agreed to,' said Smith. 'His son is saddened by the loss, but he also saddened by the fact that he's not going to be able to spend any more time with his father.' |
