| Tenn. Death Row Inmate Takes New Trial Plea to Appeals Court |

Convicted killer Philip Workman has asked the state Court of Criminal Appeals to grant him a new trial. Workman says Judge John Colton was in error when he denied a new trial late last year. Colton rejected Workman's claim that newly discovered evidence may have left the jury with reasonable doubt he should be sentenced to death. The defense argued Tuesday before a three-judge panel that Colton's ruling was based on an incorrect legal standard. The state says Colton's ruling was correct. Workman was convicted of killing Memphis Police Lieutenant Ronald Oliver in 1981. He admits shooting at police following a restaurant robbery but contends the fatal bullet did not come from his gun. Workman was less than an hour from death by lethal injection in 2001 when the Tennessee Supreme Court stopped his execution. The appeals court has no deadline for a ruling. |
