A Kentucky man freed on D.N.A. evidence after serving 13-years in prison for rape is back in jail. Herman May, whose release came about last year due to the efforts of two law students from Northern Kentucky University, was arrested March 3 after police found marijuana in his car. May's arrest comes just two months after being cited for marijuana possession. A judge has set a $100,000 bond on the marijuana charge at the request of prosecutors who are considering re-trying May. The prosecutor's office argues that the results of the DNA testing can be interpreted either way. They are asking for an evidentiary hearing so they can question the technician who performed the DNA test. The Chase law school students had arranged for May's DNA testing to show that he did not commit rape and that he had been wrongly convicted. |
