Whistle-blowing Led to Retribution, Penn. County Officer Says
By The Patriot-News
Published: 04/07/2003

A deputy warden at Dauphin County Prison has filed suit against Warden Dominic DeRose and the county, charging they punished him for pointing out corruption and abuses at the jail.
In a suit filed in U.S. Middle District Court, Deputy Warden James DeWeese charges he told DeRose about 'a litany of unlawful actions,' including the beating of prisoners and the unlawful use of public funds by top prison staff, but DeRose refused to investigate.
The suit charges he also complained about the abuses to Commissioner Anthony Petrucci and that Petrucci told DeRose rather than investigate.
Contacted yesterday, DeRose said the suit is 'absolutely meritless, entirely untrue, and the county and I will be defending this very aggressively.' He declined further comment on the specific allegations on the advice of Frank J. Lavery Jr., prison solicitor.
A county spokesperson declined comment on Petrucci's behalf.
DeWeese is one of three deputy wardens under DeRose. He has worked at the prison more than 20 years and is in charge of support operations.
He claims he was denied pay increases given to others and that DeRose became threatening when he learned that DeWeese had spoken to FBI agents probing allegations of corruption at the prison cited in an earlier suit.
The suit says DeWeese reported incidents of inmate abuse, including assaults by prison personnel and top officers, to no avail.
Deweese also says he complained that DeRose and others were being paid on county time while participating in a 'Tuesday-Thursday' golf league.
He also claims that prison vendors would give perks, such as sports tickets, to top prison staff.
He also said he was forced to use law enforcement computers to seek arrest information about private citizens for DeRose's personal purposes.
DeWeese's contact with the FBI was revealed in a deposition in another lawsuit filed by an officer who made similar allegations of reprisal for reporting wrongdoing.
The county settled with officer Christopher Lewis on Oct. 15, two days before his case was set to go to trial.
DeRose and FBI officials declined comment on whether any FBI investigation is still pending.
