Lawsuit Blames Colo. Prison in Death of Inmate

A 26-year-old man died on the night before his release from prison because officials refused to refill his $35 prescription, according to a federal lawsuit filed March 24.
Tamara L. Schlitters filed the lawsuit over the death of her son, Jeffrey A. Buller. He died at the Kit Carson Correctional Center at Burlington in 2001.
The prison is run for the state by a private company, Corrections Corporation of America.
A woman answering the telephone at the prison said no one was available to comment on the lawsuit March 24.
Buller had hereditary angioedema, which causes swelling episodes in various parts of the body, including the airways of the throat, the lawsuit said.
Buller took a prescription medication called Winstrol, but he ran out of it April 21, 2001 - 10 days before his scheduled release on parole.
Although he repeatedly asked for a refill and a doctor ordered it, the staff never obtained the medicine, according to the lawsuit.
The suit alleges that prison officials didn't want to spend the money - about $35 for a 30-day supply - because Buller was about to leave the prison.
Buller started having trouble breathing May 1, 2001, as he was packing for his release the next day, and died.
He was in prison for a sexual encounter with an underage teenage girl that occurred when he was 20, according to attorney David Lane, who filed the lawsuit for his mother.
