Two Charged with Trying to Free Montana Freemen Leader from Prison

Two men who claimed they were ''Montana marshals'' and presented fake documents demanding the release of a Montana Freemen leader from a South Carolina federal prison are in custody, the FBI said.
The men allegedly tried to spring Leroy Schweitzer, whose arrest in 1996 triggered an 81-day standoff between the FBI and other members of the anti-government group on the plains of eastern Montana.
Schweitzer is serving a 22-year sentence at the prison in Edgefield for crimes including conspiracy, bank fraud, illegal possession of firearms and participating in the armed robbery of a television crew covering the Freemen.
On March 21, Ervin Elbert Hurlbert, 82, and Donald Little, 55, walked into the prison's lobby and demanded Schweitzer's release, the FBI said.
After Hurlbert was arrested, ''he was very adamant that everything that he presented was legitimate and real,'' said Sheriff's Lt. Joel Summer.
The men were charged with instigating or assisting escape; Hurlbert also was charged with impersonating a federal officer.
The men remained in federal custody March 26 after a magistrate set bond for each at $25,000, said Assistant U.S. Attorney Jeanne Howard.
Hurlbert admitted to carrying a handgun in his vehicle for personal security, but told investigators he would not have resorted to violence to liberate Schweitzer, according to an affidavit.
Schweitzer, expected to be released in 2018, headed the Freemen, who claimed they were sovereign and not subject to jurisdiction of U.S. courts.
Members set up their own ''common-law court'' and taught classes at their compound on a farm in eastern Montana on how to write and cash bogus checks.
