The Illinois Supreme Court recently rejected a legal assault on 133 death sentence commutations granted by then-Gov. George Ryan earlier this year, but it kept alive prosecutorial opposition to blanket clemency for 34 other inmates. Also on April 5, the state House overwhelmingly passed proposals that would, among other provisions, reduce eligibility for the death sentence and require all police stations to videotape murder interrogations. That action came a day after the Illinois Senate passed a measure that would establish videotaping of interrogations in murder cases. The Supreme Court turned aside challenges to the blanket clemency brought by prosecutors in DuPage and other counties, while granting a request by Illinois Atty. Gen. Lisa Madigan to challenge the commutation of death sentences for 34 other inmates who either had not signed requests for clemency or were eligible for the death penalty but had not been sentenced. 'It appears the court was not troubled by the blanket clemency, and it's put that to rest forever,' said Barry Gross, deputy attorney general. 'However, the court has granted the attorney general's request to file [legal arguments] to resolve the unsigned and the unsentenced.' Madigan went to the court saying Ryan overstepped his authority in granting clemency to condemned prisoners who had not asked for it. She also sought to invalidate Ryan's decision to commute the terms of inmates due to be resentenced by lower courts after their previous death sentences were set aside. In January, Ryan announced the pardon of four condemned inmates and the commutation of all 167 death sentences--three to 40 years and 164 to life without parole. |
