| Texas Inmate Who Claims Retardation Granted Reprieve |

The Texas Court of Criminal Appeals on Thursday granted a stay of execution based on a mental retardation claim by a death row inmate who was convicted of fatally stabbing a Dallas civil rights lawyer and his wife. Kenneth Dwayne Thomas, 42, was set for lethal injection June 18 for the 1986 burglary and killing of Fred Finch and his wife, Mildred. Authorities said Fred Finch, 66, also had been sexually assaulted. The appeals court sent Thomas' case back to a Dallas trial court, where the inmate's mental retardation claims are to be considered. Prosecutors tried Thomas for the death of Mildred Finch after an earlier conviction for the stabbing death of her husband came under fire when attorneys learned a juror in the case had a felony conviction. Felons are not eligible for jury service. |
