Calif. Officer Jailed For Forcing Inmate To Perform Sex Acts

A veteran male prison officer who forced a male inmate to have sex with him was sentenced May 22 to a year in jail and placed on five years probation.
Kimberly Lewis, 48, pleaded guilty to a felony count of a correctional officer engaging in a sexual act with an inmate.
Superior Court Judge Browder Willis rejected defense arguments that Lewis be sentenced to credit for jail time served so he could return home to Riverside County to care for his wife, who has multiple sclerosis.
'Only two people know what truly occurred,' the judge told the defendant. 'You violated a very sacred trust.'
Willis said the defendant's mistreatment of the inmate under the color of authority 'makes this matter as egregious as it can be.'
Prosecutors had charged Lewis with 10 felony counts, meaning he could have gotten up to 16 years in prison had he been convicted.
Lewis, who has worked for the California Department of Corrections for 17 years, was placed on administrative leave Jan. 24, after being overheard describing urges to discharge lethal weapons toward people of Asian descent.
No charges were filed in connection with that incident, and defense attorney Attorney Everett Bobbitt said Lewis, a Vietnam War veteran, has sought counseling on his own for Post-Traumatic Stress Syndrome.
'He has lost his employment. He's never going to work in law enforcement again,' Bobbitt told the judge.
Investigators began looking into Lewis last Aug. 29, when the state Office of the Inspector General got a letter from a 32-year-old inmate saying he was twice forced to perform a sex act on the officer, according to the declaration.
The inmate was told there would be problems and new charges could be lodged against him if he did not comply with the officer's demand for sex, according to the declaration.
The incidents happened in November and December 2001, the inmate letter states.
