Two former Webster, Louisiana sheriff's deputies each faces a misdemeanor charge of simple battery in connection with last month's alleged abuse of an inmate. Both were fired after an internal investigation revealed a violation of office policy. John Smith and Brian Mitten, former officers at Bayou Dorcheat Correctional Center, were booked into their former place of employment and released on bonds of $1,000 each. Results of an internal investigation into a complaint inmate William 'Jimmy' Smith filed about his treatment April 29 have been turned over to District Attorney Schuyler Marvin and Assistant District Attorney Sherb Sentell III, Webster Sheriff Ted Riser said. Smith alleges that he was handcuffed to cell bars for an extended period of time, the deputies pulled his pants down, threatened him with a mop handle and struck him with a belt. 'It started out as horseplay ... but it got out of hand,' Riser said. Sentell said he and Marvin agreed 'definitely a criminal act was committed' through the use of the belt. 'Simple battery is any offensive touching no matter how minor,' Sentell said. 'Schuyler wanted to make it clear that no matter if you are an inmate or convicted felon, you have rights ... and this is conduct that will not be tolerated. No one is above the law.' If convicted, Smith and Mitten each faces six months in jail and-or up to a $1,000 fine. |
