DNA Evidence Clears Man in '94 Rape Case

A Michigan man who spent nearly a decade in prison for rape was released Tuesday after a DNA analysis showed he didn't commit the crime. 
'The first thing I want to do right now is go to church and say some prayers of thanks,' Kenneth Wyniemko, 52, told reporters as he was released. 
Wyniemko had been sentenced to 40 to 60 years in prison for the rape and armed robbery of a 28-year-old Clinton Township woman in April 1994. 
The Michigan State Police Crime Lab conducted DNA testing of evidence in Wyniemko's case after it was taken up by the Innocence Project at Thomas M. Cooley Law School in Lansing. 
'The DNA absolutely excludes him,' said Macomb County Prosecutor Carl Marlinga, who dropped the charges against Wyniemko after a judge granted a defense motion for a new trial. The real assailant is unknown, Marlinga said. 
The prosecutor said he apologized to Wyniemko, who under his sentence would not have become eligible for parole until 2025. 
'This is a very gracious and understanding man,' Marlinga said. 'I hope he can get his life back together.'
