| Man Who Attacked Deputy Escapes from La. Jail |

A Kansas man serving jail time for attacking a deputy escaped from Rapides Parish (La.) jail by posing as a prisoner scheduled for release. 'The inmate who was supposed to be released didn't hear his name called,' Warden Jimmy Chevalier said. Cody Ellerman, 24, got up and headed to the door when the other inmate didn't respond Friday. He remained at large Saturday, the sheriff's office said. Ellerman and the inmate whose name was called had similar beards and were among 40 inmates in the same cell, Chevalier said. Nevertheless, Ellerman had to pass through other stations before leaving the jail, something he shouldn't have been able to do, Chevalier said. 'He was just able to figure out the security and use it to his advantage,' the warden said. 'There are safeguards in place to prevent that from happening. Apparently they weren't followed, but we are still investigating.' Ellerman was convicted April 21 on charges of aggravated assault of a police officer, resisting arrest by violence and criminal damage to property. He was sentenced to eight years in prison. The charges stemmed from an August 2002 traffic stop in which Ellerman pointed a .45-caliber pistol at Deputy Todd Poche, 33, of Deville. Ellerman also was being held on a federal charge of firearm possession by a felon and for the state of Kansas for parole violation. 'Because of the nature of the charges he will be considered dangerous,' Chevalier said. 'He's not armed that we are aware of.' Ellerman is 5-feet, 8-inches tall and weighs 215 pounds. He has closely cropped brown hair, a goatee and brown eyes. The most prominent of his numerous tattoos reads CFH on the left side of his head, the warden said. Ellerman is also known as Jonathan Davis and had a Deville address at the time of his August 2002 arrest. Jailers did not realize Ellerman was gone until they discovered the inmate who was supposed to be released three hours earlier was still there. The jail then went into lockdown and there was a head count to determine who had escaped, the warden said. Chevalier declined to release the name of the other inmate, saying, 'he was just a kid doing misdemeanor time. I don't feel he had any part in it.' |
