A prison inmate who gave birth to a daughter while imprisoned once again has her parental rights. The Arkansas Court of Appeals overturned the toddler's adoption by an aunt and uncle on June 18, saying a judge failed to follow state law in approving the adoption without Caroline Sue Ray's consent. Ray is in a Texas prison until 2006. Roy and Wanda Sellers retain guardianship of the child under the decision. The 24-year-old Ray was jailed in Arkansas when she gave birth to the girl. Wanda Sellers was appointed guardian and allowed to set visitation. After Ray was released, she was allowed to visit once a month. Then she was arrested by Texas authorities in 2001. A judge in Texarkana subsequently allowed the Sellers to adopt the child. But the appeals court says the judge failed to establish a specific time period during which Ray did not communicate with or provide care for the child, as is required under state law. |
