Jailed Mobster's Wife Can't Use Sperm

A federal judge ruled recently that a convicted New York mobster's wife cannot use her husband's sperm to get pregnant because she broke the law by bribing a guard to smuggle it out of prison.
Maria Parlavecchio had argued that it is not against the law to possess the sperm even if it was taken illegally from the minimum-security section of Allenwood, in north-central Pennsylvania.
Judge Malcom Muir wrote that even though the sperm is not contraband, allowing her to use it would reward her for committing a crime.
Her husband, Antonino Parlavecchio, was sentenced in 1992 to 14 years in prison for racketeering and other charges. Both pleaded guilty in the sperm-smuggling case. He got an additional six months; she received a year of probation.
Maria Parlavecchio's attorney, Eugene P. Tinari, said in the Feb. 1 motion seeking the return of the sperm that his client's 'chances of conception diminish every day ... due to her age. She engaged in this scheme solely as a result of her desperate desire to have a baby.'
Maria Parlavecchio, 38, of Garfield, N.J., is childless. She has decided not to appeal the motion; the government now has the court's permission to destroy the sperm, which was seized from her obstetrician-gynecologist.
