Twelve years after his brother was sent to prison for a murder, Lorenzo Branch walked into a courtroom last week and said he was the one who committed the crime. Branch said he hoped his testimony would clear his younger brother, Lamont, who was sentenced in 1990 to life in prison for shooting a man to death in a drug-infested housing project. Despite the admission, Justice James Starkey did not rule on the defense request to throw out Lamont Branch's murder conviction, and Branch remains in prison. The judge set another hearing for April 1. Lamont Branch, 38, watched the testimony from the defense table, at times wiping away tears. Prosecutors have stood by the conviction of Lamont Branch, and prosecutor Kenneth Taub challenged Lorenzo Branch's testimony. The man was shot in the head in a Brooklyn apartment in 1988. More than a year later, two men being questioned in an unrelated homicide implicated Lamont Branch in the killing. In court last week, Lorenzo Branch said on the day of the shooting, he was alone with Josephs and told him, 'You have to go.' 'Before I knew it, he was pulling a gun from his waist,' Branch said. 'I jumped at him. I pushed him. A shot rang out, and Danny fell to the floor.' He said he confessed to Lamont but did not speak about the shooting again until 1994, when he agreed to make a videotaped statement for his brother's attorney. The video prompted the judge to hold a hearing in 1997. |
