Rick Daye spent 10 years in prison for a crime he didn't commit. Now, the state is offering to pay for that mistake, 10News reported. Daye is being offered $100 for every day he spent in prison -- $389,000, 10News reported. Almost two decades ago, a San Diego jury sentenced Daye to two back-to-back life terms for kidnap and rape 10News reporter Mark Matthews first met Daye in 1994. Daye's attorney had resurrected some nearly-forgotten evidence from the rape and had it tested for DNA. The tests proved Daye was innocent. He was freed, reunited with his family, and invited to tell his story to Oprah. But when he went back to court to sue the government for taking 10 years of his life he was once again frustrated. A federal judge refused to let the jury know that Daye had spent 10 years behind bars, and he got nothing. Then, just last week, the state of California's Victims Compensation Board reconsidered Daye's case in light of new laws that allow for awards of up to $100-a-day for victims of the justice system. Daye's attorney was able to convince the board unanimously that Daye deserves the full $100 for every day he was held. Daye is currently living in Des Moines, Iowa, and was not available for reaction. But his attorney, Carmella Simoncini, said she 'couldn't be more pleased.' The state Legislature must first approve the award, but 10News reports that they are not likely to hold it up. |
