California High Court Reviews Parole Veto

The California Supreme Court said recently it would review whether Gov. Gray Davis has absolute power to overturn paroles granted by the state prison board.
The court said it would review the cases of two convicted killers who were granted parole, but who remain jailed because Davis vetoed the Board of Prison Terms' decisions.
Davis claims absolute authority to reverse the board under a 1988 law granting the governor veto powers over board decisions. But in January, a state appeals court ruled that such vetoes are reviewable.
The court did not indicate when it would consider the case.
Defense attorneys and at least one lower court have complained that Davis has an illegal blanket policy of denying parole to convicted murderers.
Of 83 convicted killers the parole board has recommended for release, Davis has vetoed 81.
