| Lawyer Requests Jail Stay For His Client |

A Vermont man charged with domestic assault who has been kicked out of a substance abuse treatment center is being held in jail because he doesn't have anywhere to live. Brian S. Tucker, 40, was jailed last week for lack of $1,500 bail after his lawyer told judge Theodore Mandeville that Tucker would show up for future court proceedings, but that he didn't have anywhere to go. Public defender Lorin Duckman told the judge that he understood he was making a rather sad request. ''Being forthright and honest with the court, I just have no place to release him to,'' Duckman said. ''The best thing I can suggest, and I feel weak doing it, is to ask that he go to jail and reasonable bail be set.'' Tucker was kicked out of Serenity House, a residential alcohol treatment in Wallingford, when a staff member suspected he had been using illegal drugs, Duckman said. It is an allegation that Duckman said his client denied. However, the facility won't take him back and now Tucker has nowhere to go, he said. Tucker has no friends in the area who can take him in, Duckman told the judge. He faces two counts of domestic assault. Police said Tucker assaulted his mother, Elizabeth Pudelka, and his girlfriend, Dawn Kleefisch, 38. Police said Tucker became angry when he believed the two women were talking behind his back. He pleaded innocent to the charges last week and bail was set at $10,000. The bail was suspended so he could go to Serenity House for counseling. Duckman said Tucker's girlfriend does not want him living with her. Tucker is not sick enough to be hospitalized and he can't get into a drug treatment facility, Duckman added. Deputy State's Attorney Peter Neary didn't object to Duckman's request to send Tucker to jail. |
